Seu retorno à ribalta eleitoral atira o País num turbilhão de incertezas, em meio a uma pandemia e ao desgoverno de Bolsonaro

A defesa do ex-presidente Lula da Silva tanto fez que conseguiu: depois de anos a invocar questões processuais para questionar as condenações de seu cliente por corrupção, finalmente foi premiada com uma decisão judicial que, na prática, livra o demiurgo de Garanhuns de prestar contas à Justiça e, ademais, lhe restitui os direitos políticos.
Desse modo, o sr. Lula da Silva pode até subir nos palanques dos grotões miseráveis onde ainda é rei para pedir votos e, eventualmente, voltar ao poder, mas ainda assim, para todos os efeitos – morais e políticos –, terá seu nome indelevelmente vinculado a múltiplos escândalos de corrupção, marca que nenhuma chicana será capaz de apagar. Lula foi até agora incapaz de explicar não apenas os mimos generosos que recebeu de empreiteiros delinquentes, objeto de suas condenações ora contestadas, mas principalmente os monstruosos esquemas de roubalheira que marcaram o mandarinato lulopetista.
A decisão do ministro do Supremo Tribunal Federal Edson Fachin que beneficiou o sr. Lula da Silva, adotada na segunda-feira, não entrou no mérito das condenações e, portanto, não considerou o chefão petista inocente de nada. O que o ministro Fachin fez foi entender que Sérgio Moro, então juiz da 13.ª Vara Federal de Curitiba, não era competente para julgar os casos envolvendo o ex-presidente, pois em tese esses casos não tinham vínculo direto com o escândalo da Petrobrás – foco da Operação Lava Jato.
De fato, era preciso um grande esforço interpretativo para incluir os casos envolvendo Lula diretamente no organograma do petrolão. Esse, aliás, é um dos pecados capitais cometidos pela Lava Jato – a pretensão de ser o patíbulo de todos os políticos e empresários corruptos do Brasil, como se todos os casos fossem conexos e como se Sérgio Moro fosse o juiz natural de qualquer processo de corrupção.
Enfatize-se, de novo, que isso nada tem a ver com a materialidade dos crimes monumentais cometidos sob as bênçãos de Lula da Silva. Mesmo com a suspeita de que Sérgio Moro foi parcial ao julgar os casos de Lula, que seria avaliada ontem pela segunda turma do Supremo, não é possível simplesmente considerar, como num passe de mágica, que não houve assalto lulopetista à Petrobrás, que não houve escandalosa promiscuidade no Congresso, que não houve indecente relação de Lula com empreiteiros.
O imbróglio, ademais, diz muito sobre o Judiciário, que sai lanhado. Não há explicação, compreensível para leigos, para o fato de que se tenha levado tanto tempo para processar, julgar e condenar Lula, mesmo diante de tantas evidências; para que a defesa do ex-presidente tenha tido tantas possibilidades de recurso mesmo com condenações em três instâncias; para que o Supremo decidisse pela enésima vez mudar a jurisprudência sobre prisão após condenação em segunda instância, o que permitiu a libertação de Lula; e finalmente para que se tenha decidido somente agora que Curitiba não era o foro correto para os casos do sr. Lula da Silva, sendo que havia jurisprudência específica sobre o escopo da Lava Jato desde 2015 – aliás, citada pelo próprio ministro Fachin em sua intempestiva decisão.
É como se o juiz resolvesse marcar, no final do segundo tempo, um pênalti supostamente cometido no primeiro. Há muitas explicações possíveis para esse casuísmo, e nenhuma delas é bonita.
Que, em meio a essa barafunda, o eleitor não perca de vista: Lula, que sempre contou com chicanas e prescrições para voltar a concorrer à Presidência, pode ser agora formalmente ficha-limpa, mas continua moralmente ficha-suja. Seu retorno à ribalta eleitoral, nessas condições, atira o País num turbilhão de incertezas, em meio a uma pandemia mortal e ao desgoverno do extremista Jair Bolsonaro.
É o pior dos mundos, situação que interessa somente aos populistas radicais e irresponsáveis que protagonizam a vida nacional há tantos anos. Mais do que nunca, quem ainda acredita na democracia e nos valores republicanos precisa se organizar, e rápido, para convencer os brasileiros de que há alternativa civilizada ao caos.
