O procurador-geral da República, Augusto Aras, enviou uma manifestação ao STF (Supremo Tribunal Federal) na 4ª feira (30.jun.2021) afirmando que a Corte não deve obrigar o Governo a comprar mais doses de vacinas contra a covid-19.
Segundo ele, não há quadro de inação do Estado que justifique a interferência da Justiça no plano nacional de imunização. Eis a íntegra (196 KB).
O parecer foi encaminhado ao ministro Ricardo Lewandowski, do STF, em resposta a um pedido apresentado pelo CFOAB (Conselho Federal da Ordem dos Advogados do Brasil) em março deste ano.
A ação se tratava de um pedido de medida cautelar para obrigar a União a comprar vacinas contra a covid-19 suficientes para garantir a imunização em massa da população brasileira.
Na ação (íntegra – 419 KB), o presidente da entidade, Felipe Santa Cruz, afirma que o governo federal vê a imunização “mais como um problema do que uma solução”. Ele cita os atrasos na campanha de vacinação e o risco do surgimento de novas variantes do coronavírus decorrentes desse retardo.
A resposta enviada por Aras menciona dados obtidos pelo Ministério da Saúde. Eles mostram que aproximadamente 100 milhões de doses de vacinas contra a covid-19 já foram aplicadas e quase 130 milhões de doses foram distribuídas em todo o país até o dia 28 de junho.
“O quadro atual demonstra o incremento gradual da oferta de vacinas e, consequentemente, do quantitativo de pessoas vacinadas, a confirmar a ausência da alegada inação a justificar a intervenção excepcional do Judiciário”, declara Augusto Aras.
“Determinação judicial que se sobreponha à programação nacional implicaria rearranjo orçamentário e de medidas definidas e em curso, com impacto relevante sobre a gestão nacional e sobre a própria operacionalização do programa de imunização”, diz.
Segundo o procurador-geral, o cumprimento do plano nacional de imunização, bem como o respeito ao cronograma previsto e à ordem de imunização dos grupos prioritários, vêm sendo acompanhados e monitorados pelo STF.
O Ministério da Saúde confirmou mais 2.081 mortes por covid-19 na 4ª feira (30.jun.2021), elevando o total para 518.066. Os casos confirmados em 24 horas foram 43.836. Desde o início da crise sanitária, são 18.557.141 diagnósticos da doença.
