O presidente do Supremo Tribunal Federal (STF), ministro Luiz Fux, seguiu à risca as normas sanitárias durante a pandemia da Covid-19. Foi e voltou para casa nos finais de semana sempre em jatinhos da FAB, sem enfrentar as aglomerações de aeroportos. Mas o custo para o contribuinte chegou a R$ 1,27 milhão em 87 voos de ida e volta ao Rio de Janeiro. Considerando todos os voos, como São Paulo e Manaus, a despesa bateu em R$ 1,38 milhão.
Esse valor representa mais de quatro vezes todas as despesas do STF com passagens aéreas para servidores e ministros no mesmo período – R$ 310 mil. As passagens aéreas dos demais ministros custaram R$ 22 mil. As despesas com passagens para assessores e seguranças que fizeram atendimento direto a ministros somaram R$ 123 mil. Mas o tribunal não informa o destino nem a data dessas viagens, alegando motivos de segurança. O tribunal informa o valor de diárias pagas a assessores, mas também não informa o destino de cada uma dessas viagens.
O custo de um jatinho no deslocamento para o Rio de Janeiro fica em torno de R$ 30 mil, considerando ida e volta. Fux costuma partir de Brasília na quinta ou sexta-feira e retorna na segunda ou terça-feira. Fez apenas três viagens a São Paulo, em visitas institucionais ao Tribunal Regional Federal (TRF) da 3ª Região. Dali, seguiu direto para o Rio, para curtir o final de semana, sempre em jatinhos da FAB, por questões de segurança. Esteve ainda em Manaus, em 13 de agosto, uma sexta-feira, no Encontro Amazonense de Notários e Registradores. No sábado, voou para o Rio.
O compartilhamento de voos entre autoridades está previsto nas normas de uso dos jatinhos “chapa branca”, sempre que possível. O presidente do STF compartilhou o seu jatinho com outras autoridades apenas cinco vezes nessas viagens para o Rio. Foi acompanhado dos ministros da Educação, Meio Ambiente, Relações Exteriores, e do presidente do Senado, Rodrigo Pacheco. Essa prática reduz a despesa pela metade. As viagens de Fux têm em média cinco passageiros, incluindo assessores e seguranças.
Fux não igualou a marca de Dias Toffoli em 2019 porque foi contaminado pelo coronavírus no início do mandato, em setembro do ano passado, quando ficou três semanas sem viajar devido à quarentena. Sem a pandemia, Toffoli fez 95 voos em 2019, com visitas a 20 cidades. Voou nas asas da FAB até para Israel. Só as diárias do presidente e assessores custaram R$ 109 mil.
Uma viagem à países da Europa custa em torno de R$ 250 mil, considerando apenas as despesas com o jatinho. Mas Toffoli também participou de uma festa no interior, em Ribeirão Claro (PR), onde inaugurou o Fórum Eleitoral Luiz Toffoli – uma homenagem ao seu pai, um cafeicultor daquela região.
Os presidentes dos da Câmara dos Deputados, do Senado Federal e do STF, o vice-presidente da República, ministros de Estado e comandantes militares têm direito a usar os jatinhos da FAB nos seus deslocamentos. Mas apenas os presidentes do Legislativo, do Judiciário e o vice-presidente podem ir para casa em aeronaves oficiais. O presidente da República tem avião exclusivo para suas viagens, além de um avião reserva.
A Presidência do STF foi questionada pelo blog se o presidente do tribunal pode voar para casa nos finais de semana sem agenda oficial. A assessoria do presidente respondeu que todas as viagens realizadas pelo presidente do tribunal em aeronaves da FAB ocorreram em conformidade com o Decreto 10.267/2020, especialmente em duas situações previstas no Art. 3º do decreto: “por motivo de segurança e de viagem a serviço”.
O decreto foi baixado pelo presidente Jair Bolsonaro em 5 de março de 2020. O decreto prevê a utilização dos jatinhos por motivos de emergência médica, segurança e viagem a serviço. Mas o art. 6º, parágrafo 5º, é mais preciso sobre os “voos para casa”: “Presume-se motivo de segurança na utilização de aeronaves da Aeronáutica o deslocamento ao local de residência permanente das autoridades de que trata o inciso II do caput do art. 2º”.
A sopa de letras e números revela que a mordomia está restrita aos presidentes do Legislativo e Judiciário. O parágrafo 4º acrescenta mais um beneficiário do privilégio: “Presume-se em situação de risco permanente o vice-presidente da República”.
O campeoníssimo no uso dos jatinhos “chapa branca” nos últimos anos foi o então presidente da Câmara dos Deputados, Rodrigo Maia (DEM-RJ). Ele torrou R$ 6,2 milhões no seu último mandato como presidente (2019/2020), fazendo 364 voos – 147 deles para o Rio de Janeiro, onde tem residência.
